PointsBet Australia Fined for Violating Online Gambling Laws
The Australian Communications and Media Authority (ACMA) recently imposed a hefty fine of over half a million Australian dollars on PointsBet Australia for breaching the country’s online marketing and gambling self-exclusion regulations.
Violation of Spam Laws
ACMA’s investigation revealed that PointsBet had sent around 800 promotional emails that violated Australia’s laws on spam. The operator was fined AUD 500,800 for these violations and is now bound by enforceable undertakings.
The emails in question were sent between September and November 2023 and contained direct links to PointsBet’s wagering platform. Despite labeling the emails as “non-commercial,” the ACMA determined that they were, in fact, promotional in nature, making them subject to Australia’s spam rules.
In addition to the spam violation, PointsBet also sent 7 marketing emails without recipient consent and 90 commercial texts without proper contact information.
Targeting Self-Excluded Individuals
One of the most serious violations by PointsBet was sending marketing messages to self-excluded individuals. The National Self-Exclusion Register (NSER) found that PointsBet had sent 508 marketing messages to self-excluded individuals between August and September 2023.
Although no excluded customers were able to gamble during this period, ACMA deemed these actions to be a severe violation of Australia’s gambling laws. PointsBet has since agreed to comply with spam and NSER laws, providing regular training for staff.
ACMA’s Response
ACMA chair Nerida O’Loughlin condemned PointsBet’s actions, stating that operators have a responsibility to protect vulnerable individuals from harm. She emphasized the importance of upholding the integrity of the NSER and ensuring that self-excluded individuals are not targeted by gambling operators.
O’Loughlin warned that failure to comply with the enforceable undertaking could result in further financial penalties for PointsBet in the future.

Despite the recent fines and violations, PointsBet is currently considering takeover proposals from Betr and MIXI. The company’s future remains uncertain as it navigates the consequences of its actions and potential changes in ownership.
